1. Definition of Terms

1.1 Agreement means this document outlining the terms of use, as made applicable in the situation or transaction.

1.2 Service Provider means Article Marketing Wizards and any of its authorized representatives.

1.3 Client means the individual, company or party that is dealing with Article Marketing Wizards, and to whom the Agreement is addressed.

1.4 Services means article writing services rendered in the past or that will be delivered in the future by the Service Provider to the Client.

2. General

2.1 By purchasing Services from Article Marketing Wizards, the Client implicitly agrees with the terms set forth in this Agreement. Terms and conditions may change without prior notice.

2.2 The terms set forth in this agreement are meant specifically for use with Services as defined above. Purchases of any other service or product from Article Marketing Wizards will be subject to the respective terms of the individual products or services.

3. Liabilities of the Service Provider

3.1 Until the Client has fulfilled its responsibilities with regard to payment and furnishing of sufficient information, the Service Provider is not required to deliver any Services, any previous agreements notwithstanding.

3.2 The Service Provider shall use all reasonable means to protect the Client’s interest in delivering Services.

4. Liabilities of the Client

4.1 Upon reaching an agreement favorable to both sides, the Client is required to send payment to the Service Provider, as well as any information that the latter deems necessary to deliver the Services.

4.2 Any losses, whether direct or indirect, resulting from transacting with the Service Provider are the sole liability of the Client. This clause includes but is not limited to losses of revenue (real or expected) or goodwill.

4.3 The Client is responsible for ensuring that the Services purchased are within the laws of its own jurisdiction. The Service Provider shall not be held liable for breaches of law resulting from the Client’s use of its Services.

5. Indemnities

5.1 Because of the complex and dynamic nature of algorithms used by search engines for ranking, the Client agrees to hold the Service Provider free of any liability for damage of any form that the Services may cause on the Client’s website.

5.2 The Client is solely responsible for the usage of Services.

6. Warranties

6.1 The Client may elect to cancel any contract or transaction within 12 hours of the transmission of the same to the Service Provider. The Service Provider will, in good faith, refund all payments issued minus applicable fees.

6.2 The Client may also choose to request for a refund given any of the following conditions:

* Duplicate content has been detected in any of the content delivered as part of the Service
* No improvement in rankings is observed after a reasonable amount of time
* There is a delay in deliverables beyond what is deemed reasonable
* The articles delivered as part of the Service are not indexed by search engines
